This article examines the constitutional right to inclusive education and the effectiveness of the communicational accessibility measures established by the Brazilian Inclusion Act (Law No. 13,146/2015) within Brazilian Higher Education Institutions, with a focus on blind students. The study sought to answer the following question: how does the persistence of communicational barriers compromise the access, retention, and academic success of these students? The hypothesis is that the lack of communicational accessibility may constitute a violation of the constitutional principle of equality and restricts the social role of the university regarding the right to high-quality higher education for all students. A bibliographic review was conducted. The study concludes that, despite normative progress, Higher Education Institutions still fail to ensure adequate communicational accessibility for the access, retention, and success of blind students, highlighting the need for effective institutional policies and the active participation of these students in shaping solutions.
