Abstract

The aim of this article is to analyze the concept of education in the guiding documents of hospital education in the context of inclusive education and as the right of sick students to receive pedagogical assistance.
Hospital education (EH) aims to promote the continuity of formal studies for young people in hospital. This type of teaching is relatively new and based on specific documents that govern its objectives and duties. The Ministry of Education - MEC, based on the legal and pedagogical provisions of basic and inclusive education, proposes to act to ensure the right of all to regular education. Hospital Education is guaranteed by Law 13.716, of September 24, 2018, ensuring educational assistance for Basic Education students hospitalized for health treatment. According to the law, they would be entitled to educational assistance not only students admitted to hospital units, but also those who, due to some illness, are prevented from leaving their homes to attend regular school. Conceiving education in educational spaces other than the school has been a challenge and the subject of extensive discussions, both at the federal and state levels, as the central objective would be to guarantee access to studies, regardless of the situation in which the student is.
